Prestige Automotive Rental Terms & Conditions

These Rental Terms & Conditions ("Rental Terms") govern all vehicle rental transactions between Prestige Automotive ("we," "us," or "our") and the individual renting a vehicle ("Renter," "you," or "your"). By completing a rental reservation or taking possession of a rental vehicle, you agree to be bound by these Rental Terms in full.

These Rental Terms are in addition to, and do not replace, our general Terms of Use and Privacy Policy.

1. Rental Eligibility

To rent a vehicle from Prestige Automotive, you must meet all of the following requirements at the time of rental:

  • Be at least 21 years of age. Renters between the ages of 21 and 24 may be subject to a young driver surcharge.
  • Hold a valid, unexpired driver's license issued by a U.S. state or territory, or a valid international driver's license accompanied by a valid passport.
  • Present a valid form of payment (credit or debit card) in your name for the security deposit and rental charges.
  • Provide proof of personal auto insurance or purchase coverage through us at the time of rental.
  • Have a satisfactory driving record. We reserve the right to deny rental to any individual with a history of serious traffic violations, DUI/DWI convictions, or suspended license history.

Renters who do not meet these requirements will be denied a vehicle. We are not responsible for any costs incurred as a result of a denied rental.

2. Authorized Drivers

Only the Renter whose name appears on the rental agreement is authorized to operate the rental vehicle, unless an Additional Driver has been added to the agreement at the time of rental. Additional drivers must be present at the time of rental, meet all eligibility requirements, and may be subject to an additional daily fee.

Allowing an unauthorized driver to operate the rental vehicle is a material breach of this agreement and may result in:

  • Immediate termination of the rental agreement
  • Full liability for any damage, loss, or injury caused by the unauthorized driver
  • Forfeiture of any applicable insurance coverage

3. Insurance Requirements

You are required to maintain one of the following forms of coverage for the duration of your rental:

Option A — Personal Auto Insurance: Your existing personal auto insurance policy must extend to rental vehicles. You are responsible for confirming coverage with your insurer prior to rental. We are not liable for any gap in coverage under your personal policy.

Option B — Rental Coverage Through Us: If you do not have personal auto insurance that covers rental vehicles, you may purchase a Collision Damage Waiver (CDW) and/or Liability Protection through us at the time of rental. Rates and coverage limits will be disclosed at the time of rental.

Regardless of the coverage option selected, you remain responsible for:

  • The deductible amount under any applicable policy
  • Damage caused by gross negligence, intentional acts, or operation under the influence of alcohol or drugs
  • Damage to tires, wheels, glass, and the undercarriage unless specifically covered under your selected plan

4. Vehicle Use Restrictions

The rental vehicle may only be used for lawful purposes. The following uses are strictly prohibited:

  • Operation under the influence of alcohol, drugs, or any impairing substance
  • Use in any race, speed test, or off-road activity
  • Transporting passengers or goods for hire (rideshare, delivery, or commercial use) without prior written authorization
  • Towing or pushing any other vehicle or trailer
  • Operation outside the continental United States without prior written authorization
  • Use by any person not listed as an authorized driver on the rental agreement
  • Carrying more passengers than the vehicle's rated seating capacity
  • Transporting hazardous, flammable, or illegal materials

Violation of any use restriction voids all damage waivers and may result in immediate termination of the rental agreement and full liability for any resulting damage or loss.

5. Damage Policy

You are responsible for all damage to the rental vehicle that occurs during your rental period, regardless of fault, including but not limited to:

  • Collision damage (including single-vehicle accidents)
  • Vandalism, theft, or attempted theft
  • Damage caused by weather, road debris, or acts of nature
  • Interior damage, staining, or excessive soiling
  • Missing equipment or accessories

Pre-Rental Inspection: Before taking possession of the vehicle, you and a Prestige Automotive representative will conduct a joint inspection and document any pre-existing damage on the rental agreement. You are encouraged to photograph the vehicle before departure. Any damage not noted on the pre-rental inspection form will be presumed to have occurred during your rental period.

Post-Rental Inspection: Upon return, the vehicle will be inspected in your presence when possible. If you return the vehicle outside of business hours, the inspection will be conducted the next business day and you will be notified of any findings.

Damage Charges: You will be billed for the cost of repair at our standard rates, plus any applicable administrative fees and loss-of-use charges for the period the vehicle is out of service for repairs.

6. Fuel Policy

Vehicles are provided with a full tank of fuel and must be returned with a full tank. If the vehicle is returned with less than a full tank, you will be charged for the missing fuel at a rate that may exceed local pump prices, plus a refueling service fee. We do not provide refunds for fuel returned above the level at pickup.

7. Mileage

Unless otherwise stated in your rental agreement, rentals include unlimited mileage within the continental United States. Mileage restrictions, if applicable, will be disclosed at the time of reservation and noted on your rental agreement.

8. Rental Period & Extensions

The rental period begins when you take possession of the vehicle and ends when the vehicle is returned to our facility and accepted by a Prestige Automotive representative. Vehicles must be returned by the date and time specified in your rental agreement.

Late Returns: Vehicles returned after the agreed return time without prior authorization will be charged at the applicable daily rate for each additional day or partial day, plus a late return fee.

Extensions: If you need to extend your rental, you must contact us before the scheduled return time. Extensions are subject to vehicle availability and must be approved in writing. Unauthorized extensions may result in the vehicle being reported as overdue or unreturned.

9. Cancellation & Refund Policy

  • Cancellations made 48 hours or more before the scheduled pickup: Full refund of any prepaid rental charges.
  • Cancellations made less than 48 hours before the scheduled pickup: A cancellation fee equal to one day's rental rate will be charged.
  • No-shows: Renters who fail to pick up the vehicle without canceling will be charged a no-show fee equal to one day's rental rate.
  • Early returns: No refund will be issued for unused rental days unless the early return is due to a mechanical failure of the rental vehicle.

Refunds, where applicable, will be processed to the original payment method within 5–10 business days.

10. Breakdown & Roadside Assistance

In the event of a mechanical breakdown, flat tire, or other roadside emergency, contact us immediately at (708) 825-9388. Do not attempt to repair the vehicle yourself or authorize repairs by a third party without our prior written approval. Unauthorized repairs will not be reimbursed.

We will make reasonable efforts to provide a replacement vehicle in the event of a covered mechanical failure. We are not responsible for any incidental or consequential costs arising from a breakdown, including transportation, lodging, or lost time.

11. Traffic Violations & Tolls

You are solely responsible for all traffic citations, parking tickets, toll charges, and other fines incurred during your rental period. If we receive a citation or toll notice related to your rental, we will forward it to you and may charge an administrative processing fee in addition to the underlying fine or toll amount.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Prestige Automotive shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your rental, including but not limited to loss of income, loss of profits, or personal injury, except where such liability cannot be excluded under Illinois law.

Our total liability to you for any claim arising from a rental transaction shall not exceed the total rental charges paid by you for the applicable rental period.

13. Governing Law

These Rental Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under these Rental Terms shall be subject to the exclusive jurisdiction of the courts located in Cook County, Illinois.
